KickLight Inc. Privacy Policy

The use of the KickLight website(s) and/or KickLight software and any KickLight services and products (collectively, the “KickLight Service”) provided by KickLight Inc. (“KickLight”) are subject to the provisions of this Privacy Policy, including any amendments or updates hereto. This Privacy Policy is incorporated into and is subject to the KickLight Terms and Service.

It is very important that you read and understand our Privacy Policy. If you do not accept the terms set out in our Privacy Policy, please do not use the KickLight Service.

We may update this Privacy Policy from time to time. Your use of the KickLight Service constitutes your acceptance of the terms of our Privacy Policy, as may be amended or revised by us, and you are advised to consult our Privacy Policy regularly for any changes. Revisions will typically be reflected by the "last updated" notation above.

What This Privacy Policy Covers

You can watch videos on KickLight without having a KickLight account. You can also contact us about a particular video without having a KickLight account.

Certain other activities on KickLight -- like uploading videos, posting comments, flagging videos, or watching restricted videos -- require you to have a KickLight account. We ask for some personal information when you create a KickLight account, including your email address and a password, which is used to protect your account from unauthorized access. Once you register with KickLight and sign in to our services, you are not anonymous to us.

This policy covers how KickLight treats personal information that KickLight collects and receives, including information related to your past use of KickLight Services. Personal information is information about you that is personally identifiable like your name, address, email address, or phone number, and that is not otherwise publicly available.

Any personal information or video content that you voluntarily disclose online (on discussion boards, in messages and chat areas, within your playback or profile pages, etc.) becomes publicly available, published content and can be collected and used by others. Such information is not considered personally identifiable information subject to this Privacy Policy.

You may, of course, decline to submit personally identifiable information through KickLight, in which case you can still view videos and explore KickLight, but KickLight may be unable to provide certain services to you.

Please be aware that although portions of the KickLight Service (including Kicks) may contain links to other third party websites that you may access, this Privacy Policy does not apply to the practices of companies that KickLight does not own or control, or to people that KickLight does not employ or manage. These other sites have their own privacy policies, and you should review those policies before following those links. We cannot control the information disclosed at these third-party sites or how that information is used.

Information Collection and Use

KickLight may record information about your usage, such as when you use KickLight, the channels, groups, and favorites you subscribe to, the contacts you communicate with, the videos you watch, the Kicks that you add to videos, the frequency and size of data transfers, as well as information you display or click on in KickLight (including UI elements such as Kicks, settings, and other information). If you are logged in, we may associate that information with your account.

We may automatically collect certain aggregated data regarding use of the KickLight Service, like the number of users and frequency and manner of usage of the KickLight Service. Aggregated information is anonymous, statistical information that reflects the scope of our user base, sales, customer patterns, and related site information. We use this information to better understand how the KickLight Service is used, and to improve the online experience of our users. This information is not used in a way that will personally identify you.

KickLight may combine information that we have about you with information we obtain from business partners or other companies.

Information Sharing and Disclosure

KickLight does not rent, sell, or share personal information about you with other people or nonaffiliated companies except to provide products or services you've requested, when we have your permission, or under the following circumstances:
  • We may provide the information to trusted partners who work on behalf of or with KickLight under confidentiality agreements. These companies may use your personal information to help KickLight communicate with you about offers from KickLight and our marketing partners. However, these companies do not have any independent right to share this information.
  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
  • We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of KickLight's terms of use, or as otherwise required by law.
  • We may transfer information about you if KickLight is acquired by or merged with another company. In this event, KickLight will notify you before information about you is transferred and becomes subject to a different privacy policy.

KickLight may display targeted advertisements or Kicks based on personal information. Advertisers (including ad serving companies or video producers who include advertising Kicks with their videos) may assume that people who interact with, view, or click on targeted ads (including Kicks) meet the targeting criteria - for example, men ages 18-24 from a particular geographic area.

KickLight does not provide any personal information to the advertiser when you interact with or view a targeted ad or Kick. However, by interacting with or viewing an ad or Kick, you are consenting to the possibility that the advertiser will make the assumption that you meet the targeting criteria used to display the ad or Kick.

We reserve the right to send you certain communications relating to the KickLight Service, such as service announcements, administrative messages and the KickLight newsletter, that are considered part of your KickLight account, without offering you the opportunity to opt-out of receiving them.

Cookies

KickLight may use cookies to track and understand the traffic on our website. Cookies are alphanumeric identifiers that our website places onto your computer's hard drive. Cookies identify your computer hard drive so that we can recognize you the next time you visit us. We use cookies to collect and store some information about you, such as the name of the domain and host from which you access the Internet, the Internet Protocol (IP) address of the computer you are using, the date and time you access our website and the Internet address of the website from which you linked directly to our website. We use this information to better understand our users and customize our site for users' particular preferences. In the same manner, we may also engage third parties to monitor the usage of, and serve advertising to, the KickLight Service. These third parties may use cookies and web beacons (which collect non-personally identifiable information regarding user behavior on our website) to collect such information, which is also used to better understand our users and customize our site for users’ particular preferences. You may disable cookies by following directions on your web browser. Disabling cookies also disables web beacons. You should be aware, however, that by disabling cookies you may be unable to access certain services and features of the KickLight Service. KickLight may allow some partners that show advertisements on KickLight products set and access their cookies on your computer. Other companies' use of their cookies is subject to their own privacy policies, not this one.

Children

KickLight is a general audience site and is not directed to children under the age of 13. KickLight believes that parents should supervise their children's online activities and consider using parental control tools available from online services and software manufacturers that help provide a kid-friendly online environment. These tools can also prevent children from otherwise disclosing online their name, address and other personal information without parental permission.

Confidentiality and Security

KickLight is committed to taking appropriate measures to protect your privacy against unauthorized disclosures. KickLight uses a variety of secure techniques designed to protect your information.

While we have implemented safeguards, you should be aware that Internet security technology rapidly changes. As such, we cannot guarantee that the safeguards we employ today can protect your personal information from the threats of tomorrow, or that our security measures are failsafe and not subject to circumvention or unauthorized intrusion.
